Terms of Service

1. Acceptance of Terms

By creating an account or using PodWave ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

PodWave lets you generate artwork using third-party AI models (including Google Gemini and Ideogram) and publish that artwork as physical products through print-on-demand fulfillment partners (including Printify). Payments are processed through Stripe. Your use of these integrated services is also subject to each provider's own terms.

3. Accounts

You must be at least 18 years old to use PodWave. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. Acceptable Use Policy

4.1 Prohibited Content

You may only use PodWave's generation features to create lawful content. You agree that you will not use the Service to generate, upload, store, or publish content that:

  • depicts, sexualizes, or implies the sexualization of minors in any way — this is prohibited absolutely, with no exceptions, and reported to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement wherever legally required
  • is sexually explicit or pornographic
  • depicts non-consensual sexual content, bestiality, or incest
  • is illegal, harmful, or facilitates a crime under applicable law
  • is defamatory, or infringes another party's copyright, trademark, right of publicity, or other intellectual property or privacy rights
  • depicts real, identifiable private individuals without their consent, or is intended to harass, defame, or impersonate a specific person
  • promotes or provides instructions for violence, self-harm, or illegal acts
  • constitutes hate speech or incites discrimination against a protected group
  • otherwise violates applicable law, or the acceptable-use policies of Google, Ideogram, Printify, or Stripe

4.2 Prohibited Technical Conduct

You also agree that you will not:

  • reverse engineer, decompile, disassemble, or otherwise attempt to extract the underlying AI models, model weights, training data, or source code made available through the Service
  • scrape, crawl, harvest, or systematically extract data, prompts, or outputs from the Service using bots, scripts, or other automated means outside of the Service's own interface
  • attempt to bypass, disable, probe, or circumvent any content moderation, safety filter, or rate-limiting mechanism, including through prompt injection, jailbreaking, adversarial prompting, or obfuscated or encoded prompts designed to evade filters
  • use the Service to develop, train, fine-tune, or benchmark a competing AI model or product
  • probe, scan, or test the vulnerability of the Service, or attempt to gain unauthorized access to any account, system, or network connected to it

4.3 Enforcement

If we believe, at our sole discretion, that you have violated Section 4.1 or 4.2, we reserve the absolute right — without prior notice and without liability to you — to: immediately suspend or terminate your account and access to the Service; remove, disable access to, or delete any content you have submitted or generated; and cooperate fully with law enforcement, courts, or regulators, including by disclosing account information, prompts, generated content, IP addresses, and any other relevant data, where we believe in good faith that doing so is required by law or necessary to prevent harm. Exercise of these rights does not entitle you to a refund or other compensation, except where mandatory consumer-protection law applicable to you provides otherwise and cannot be excluded by agreement.

Violations involving illegal content, including CSAM, will be reported to the appropriate authorities regardless of whether the account is also terminated. Prompts and generation requests are automatically screened before and after being sent to our AI providers.

5. Content Ownership

As between you and PodWave, you own the artwork you generate through the Service, subject to your compliance with these Terms and to the terms of the underlying AI providers (Google Gemini, Ideogram) whose models were used to create it. PodWave claims no ownership over content you generate. You are solely responsible for ensuring you have the right to sell any resulting product.

6. Disclaimers

The Service, including all AI-generated content, is provided "as is" without warranties of any kind. AI-generated artwork may occasionally be inaccurate, low quality, unexpected, or resemble existing works despite our safeguards — you are responsible for reviewing content before publishing or selling it.

7. Limitation of Liability

To the maximum extent permitted by law, PodWave and its operators are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including losses related to fulfillment partner account actions, third-party AI provider outages, or content generated by other users.

8. Indemnification

You agree to indemnify and hold PodWave harmless from any claims, damages, or expenses (including legal fees) arising from content you generate or publish through the Service, or from your violation of these Terms.

9. Governing Law & Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them (including their existence, validity, interpretation, or termination), are governed by and construed in accordance with the laws of the Republic of Poland, excluding its conflict-of-laws rules and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

PodWave is operated by Antoni Karolewski, a sole proprietor (jednoosobowa działalność gospodarcza) registered in Poland, NIP PL9512445307, registered address: ul. Grupy Kampinos 43B, 05-152 Palmiry, Poland. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the common court having jurisdiction over that registered address.

If you are a consumer habitually resident in another European Union member state, the above choice of law and forum does not deprive you of the protection afforded by the mandatory consumer-protection provisions of the law of your country of residence that cannot be derogated from by agreement, and you may also bring proceedings before the courts of that member state, in each case to the extent required by Regulation (EU) No 1215/2012 and Regulation (EC) No 593/2008 (Rome I).

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
